Senior Member Position

The State Administrative Tribunal (SAT) is an independent body established under the State Administrative Tribunal Act 2004 (WA). It has a wide ranging jurisdiction to make original decisions and to review administrative decisions made by WA Government Ministers, public officials, vocational regulatory bodies and local governments.

The SAT is seeking expressions of interest from persons who wish to be considered for appointment to fill two full-time Senior Member positions and up to three full-time Ordinary Member positions. Appointments are made by the Governor in Executive Council. Appointment of Members is provided for in section 117 – 119 of the SAT Act. It is anticipated that the appointments made as a result of this process will be for a period of five years. All Members are eligible for reappointment.

Both the Senior Member and Ordinary Member positions are full-time positions but, subject to the needs of the Tribunal, consideration may be given to filling the positions by a combination of part-time appointments.

A pool of additional persons who may be suitable for appointment may be established from this process. Any such pool would be open for 12 months, during which time persons placed in the pool can be considered for recommendation for appointment to further Member positions if and when they arise. Placement in the pool does not guarantee an appointment.

SAT’s jurisdiction covers the following areas:

  • Commercial and Civil, including the areas of strata titles, retirement villages, commercial tenancies, building disputes;
  • Development and Resources, including the areas of local government, planning and taxation;
  • Human Rights, including the areas of guardianship and administration, and equal opportunity; and
  • Vocational Regulation, including disciplinary action and licensing in relation to a range of regulated vocations.

Senior Member Position

Both positions which need to be filled arise from the expiry of the terms of two existing Senior Members in August and September respectively.

On this occasion the needs of the Tribunal are such that persons wishing to be considered for appointment should have relevant legal qualifications and at least eight years’ legal experience.


Ordinary Member Positions

Two Ordinary Members positions will become vacant due to the expiry in September of the terms of appointment of two currently appointed Ordinary Members.

Persons wishing to be considered for appointment to the positions of Ordinary Member must have either:

  • Relevant legal qualifications and at least five years’ legal experience; or
  • Extensive knowledge of, or experience with, any class of matter involved in the exercise of SAT’s jurisdiction.

It is likely that the persons appointed to the Senior Member and Ordinary Member positions will be allocated work in the Tribunal’s Commercial and Civil stream and/or its Human Rights stream. It is therefore highly desirable that persons wishing to be considered for appointment have experience in matters relevant to those streams. Qualifications and experience in mediation are also highly desirable.
